Privacy policy

1.     GENERAL

1.1. This privacy policy ("Privacy Policy") applies to all processing of personal data performed by Econans AB, reg. no. 559113-0553 ("Econans") unless otherwise agreed in writing. It covers all websites, services, and online applications owned, controlled, or hosted by Econans ("Services").

1.2. "Personal Data" means any information relating to an identified or identifiable natural person ("Data Subject").

1.3. Econans may process Personal Data either as a data controller or a data processor on behalf of its customers (each a "Data Controller"), in accordance with Regulation (EU) 2016/679 (GDPR). When acting as a data processor, processing is governed by a data processing agreement. Questions regarding such processing should be directed to the respective Data Controller.

1.4. This Privacy Policy ensures that Econans handles Personal Data in accordance with applicable laws. It describes how Personal Data is processed, the Data Subject's rights, and how to contact Econans.

1.5. If this Privacy Policy is updated, changes will be announced via the website or email. Data Subjects are encouraged to revisit it regularly.

2.     COLLECTION OF PERSONAL DATA

Econans may collect the following categories of Personal Data:

  • Identification and contact information: name, email address, phone number, company name, company address, job title, home address.

  • Device and browser data: language, browser version, type, header referrer, user agent, operating system, screen resolution, mobile detection.

  • Usage data: visited URLs, timestamps, referring pages, files accessed (e.g. HTML pages, images).

3.     PURPOSE AND LEGAL BASIS FOR PROCESSING

The purposes for which Econans processes Personal Data and the corresponding legal bases are:

a) To provide the Services in full – contractual necessity
b) To personalize the Services and improve user experience – legitimate interest
c) To send relevant content via email or other marketing – consent
d) To market the Services based on user preferences – consent
e) To share aggregated statistical data – legitimate interest
f) To notify users, where applicable, of changes to Econans’ terms of service, this Privacy Policy, or other legal documents – legitimate interest or contractual obligation, depending on the relationship with the Data Subject.
g) To fulfill legal obligations from public authorities – legal obligation
h) To ensure technical functionality and prevent security issues – legitimate interest
i) To respond to customer service requests – contractual necessity
j) To fulfill contractual or legal obligations to the Data Subject – contractual necessity / legal obligation

3.6. When processing on behalf of a Data Controller, the controller is responsible for determining the appropriate legal basis. Econans processes Personal Data only in accordance with the instructions of the Data Controller, who is responsible for ensuring a valid legal basis under GDPR.

5.     SENSITIVE PERSONAL DATA AND MINORS

5.1. Econans does not collect or store sensitive Personal Data or data about individuals under 18. If we become aware that we have collected data from a child under 18 without verified parental consent, we will delete it immediately.

6.     STORING OF PERSONAL DATA

6.1. Personal Data is stored in Econans’ databases hosted on external servers within the EU/EEA by AWS (Amazon Web Services). All data is processed and stored within the European Union in accordance with GDPR requirements.

6.2. Personal Data is not retained longer than necessary for the purpose it was collected. If required by law (e.g. accounting), retention periods may apply.

6.3. Data is routinely deleted or anonymized in accordance with applicable laws.

7.     SHARING OF PERSONAL DATA TO THIRD PARTIES

7.1.   Without the Data Subject's explicit permission, Econans will not share the Data Subject's Personal Data with any third party in any other way than what follows from this Privacy Policy, unless Econans is obliged to do so following the applicable regulations or unless the Personal Data is shared in connection with an ongoing legal-, administrative- or recovery procedure in which the Data Subject and Econans are both parties.

7.2.   Econans uses subcontractors for services in connection with Econans’ Services (“Data Processors”). These Data Processors may handle Personal Data and may need some access to Personal Data collected through the Services. Econans may also need to use the Data Processor’s to store Personal Data. Econans will always limit such Data Processors’ access to Personal Data to the minimal amount needed for Econans to still be able to offer the Services. Econans also requires all Data Processors s to (i) protect the Data Subject's Personal Data in accordance with this Privacy Policy and (ii) not use or disclose the Data Subject's Personal Data for any purpose other than to provide the agreed upon services to Econans, enabling Econans to offer the Services. These Data Processors may only process the Data Subject's Personal Data in accordance with Econans’ instructions and may not use the Data Subject's Personal Data for any other purpose. The following Data Processors might be involved in the processing of Personal Data: [t.ex. Microsoft Azure, Amazon Web Services, Google Cloud Web etc.].

7.3.   Econans may share Personal Data and information with additional Data Processors based on a request from the Data Subject as part of a service or add-on product.

7.4.   Econans may also share information with additional Data Processors for the following purposes: analytics, support, data enrichment or marketing.

7.5.   Should Econans, or the assets Econans control, be acquired by another company, e.g. through a merger, acquisition, bankruptcy or similar event, such company will also acquire access to all information that Econans gathered through the Services. In such case, the Data Subject will be notified of this, through e-mail or a clear notification in the Services.

7.6.   Econans reserves the right to disclose Personal Data if required by law or if Econans reasonably believe that disclosure is necessary to protect Econans’ rights, protect the safety of the Data Subject or the safety of others, investigate fraud, or comply with a law, court order, or legal process. 

8.     TRANSFERS TO THIRD COUNTRIES

Econans does not currently transfer data outside the EU/EEA. If such transfers occur, they will comply with GDPR requirements and adequacy mechanisms.

9.     RIGHT TO ACCESS

9.1. The Data Subject has the right to obtain a copy of the Personal Data undergoing processing. Requests must include sufficient information to verify the Data Subject’s identity and specify the information requested.

9.2. Responses will be provided within 30 days, or notification given if delays occur.

10.  RIGHT TO RECTIFICATION

10.1. The Data Subject may request correction of inaccurate or incomplete Personal Data.

10.2. Econans will notify third parties, where applicable, of such corrections unless unreasonable.

11. RIGHT TO ERASURE AND RETENTION

11.1 Personal Data will be deleted when:

  • it is no longer necessary for the purposes for which it was collected or otherwise processed;

  • the Data Subject withdraws consent, where consent is the legal basis for processing;

  • the Data Subject objects to processing for direct marketing purposes;

  • the processing was unlawful;

  • there is a legal obligation to delete the data under applicable law.

11.2 Econans will assess each request for erasure individually and objectively, in accordance with applicable data protection laws. If the request is accepted, Personal Data will be deleted or de-identified within 30 days of receipt.

11.3 Econans may retain Personal Data beyond the time of an erasure request only if necessary for:

  • compliance with a legal obligation that requires retention;

  • the establishment, exercise, or defense of legal claims.

11.4 In cases where Personal Data has been shared with third parties, Econans will take reasonable steps to notify relevant recipients of the deletion request, unless this proves impossible or involves disproportionate effort.

12.  RIGHT TO RESTRICT PROCESSING

12.1. Restriction applies when:

  • Accuracy of data is contested

  • Processing is unlawful and deletion is not requested

  • Data is required for legal claims

  • Objection to processing is made and pending evaluation

13.  RIGHT TO DATA PORTABILITY

The Data Subject may request to receive Personal Data provided to Econans in a machine-readable format if the processing is based on consent or contract and is technically feasible.

13.1. AUTOMATED DECISION-MAKING

Econans does not use Personal Data for automated decision-making, including profiling, that produces legal effects concerning the Data Subject or similarly significantly affects them.

13.2. DATA BREACH NOTIFICATION

In the event of a personal data breach, Econans will notify affected Data Subjects and relevant supervisory authorities in accordance with Articles 33 and 34 of the GDPR.

 

14.  RIGHT TO COMPLAIN

The Data Subject may lodge a complaint with Integritetsskyddsmyndigheten (IMY) or another supervisory authority.

15.  SECURITY

Econans applies appropriate technical and organizational security measures to protect Personal Data against unauthorized access, loss, or disclosure.
